Cooperative Bank MD Gideon Muriuki risks jail term for disobeying a court order in a Sh 3.1b suit

The Managing Director of Cooperative Bank Dr Gideon Muriuki has been accused of ignoring a court order in a Sh 3.1 billion, and instead continued to permit withdrawals, debits, transfers and other transactions on the said account.

The applicants/decree holders now want he and and his two legal officers cited for contempt of court and sent to jail for six months for the blatant disobedience of the Court Order.

Through their lawyer, Gichuki King’ara, the applicants told the court that the continued transactions on the said account was intended to dissipate and/or conceal funds capable of satisfying the decretal sum of Kshs. 3,176,431,039.14 together with accrued interest and thereby frustrate execution of the lawful decree of the Court.

The Employment and Labour Relations court sitting in Nairobi issued an order freezing accounts in Cooperative Bank, Kenya Commercial Bank, Citi Bank, Standard Chartered, Equity Bank and Safaricom in relation to the Sh 3.1billion suit.

But the applicants/decree holders discovered that despite the order, Cooperative Bank to permit withdrawals, debits, transfers and other transactions on the said account.

They now want Muriuki and his two legal officers Samuel Kibugi, Melody Yego to stand committed to jail for 6 months for contempt of court by willfully violating, disobeying and/or disregarding the orders issued on the 16th April, 2026.

They also wanted Cooperative Bank ordered to immediately pay to the Applicants/Decree Holders the sum of Kshs. 3,737,572/= which sums or amount were released, debited, withdrawn, transferred and/or otherwise allowed out of Account Number 01120065195300 ignoring the court order freezing the account.

King’ara further said that the decree holders have also discovered that Cooperative Bank has filed two contradictory Replying Affidavits both dated 11th May 2026 through its Legal Officer, Melody Yego, wherein one affidavit indicates that the account hold a credit negative clear balance of Kshs. -3,173,321,588.20 while another affidavit discloses a Debit negative balance of Kshs. -24,435,090/= in respect of the same account.

He said the contradictory affidavits raise serious concerns of perjury, falsification and/or tampering with bank records intended to mislead the Court and defeat the course of justice.

King’ara while urging the court to act fast, he said unless his application was heard urgently and appropriate preservatory and punitive orders issued immediately, Cooperative Bank and the Respondent/Judgment Debtor may continue dissipating and/or concealing funds thereby rendering the garnishee proceedings nugatory.

He said the dignity, authority and integrity of the Court was under direct attack through deliberate disobedience of Court Orders and misleading of the Court by officers of Cooperative Bank

The applicants are employees and former employees of East African Portland Cement Company.
