The shocking court ruling that declared Building Bridges Initiative (BBI) constitutional amendment process illegal has been declared an error that will be set aside by the Court of Appeal.
BBI Secretariat co-chair Dennis Waweru said the ruling would be immediately appealed and they are confident the judgment and the orders issued would be reversed.
And the anti-BBI squad was in a celebratory mood led by the Deputy President who in a tweet said, ‘’there is a God in heaven who loves Kenya immeasurably. May God’s name be praised forever.’’
Prominent City Lawyer Donald Kipkorir while dismissing the massive ruling said the five judges were playing to the public gallery for cheers.
He said he wholly and totally disagreed with the jurisprudence, reasoning, philosophy and tenor of the judgment.
“Constitutional amendments are subjects only to articles 255, 256 and 257. To measure it against other articles is an egregious error that the Court of Appeal must correct,’’ said Kipkorir
He added that law is immutable, it is not excitable, it does not speak to the public gallery for cheers neither does it seek to be seen as independent by countermanding every word of the Executive.
“It doesn’t seek to excite those in Githurai bus stage and it does not dance to the beats of the seasons,’’ he concluded.
Nark Kenya leader Martha Karua and a member of Linda Katiba lobby group was also in a celebratory mood saying the ruling was a great affirmation to the constitutionalism and the rule of law.
Supporters of BBI described the ruling as a small set back but took issue with the tone of the judgment and what appeared to be a direct attack on President Uhuru who the judges declared had breached Chapter Six of the Constitution on leadership.
This was seen as an attempt to expose the President to a vote of no confidence or impeachment because of his leading role in the promotion of BBI. It was also seen as an attempt to stop the President from pushing forward with the BBI process and in the process kill the process.
