The inquest into the death of former Nyeri governor Wahome Gakuru took a dramatic turn when his predecessor Mutahi Kahiga and Mathira MP Rigathi Gachagua were summoned to appear.
The court wants the two politicians to appear and shed light on areas it has described as grey in the inquiry into the tragic death of second governor of Nyeri County.
And the court issued a warrant of arrest against four police officers who attended to the scene where late governor Wahome Gakuru died in a car crash at Makenji area in 2017.
Chief Magistrate Wendy Kagendo issued the order for the arrest of Sgt John Wanami, Sgt Martin Simiyu, Cpl Francis Kisavi and police constable John Kivuva after they failed to appear at the scene.
The warrant of arrest is to be effected by Makuyu police officer commanding police division.
Kagendo also gave summons for Nyeri governor Mutahi Kahiga ,Mathira MP Rigathi Gachagua, County Secretary Benjamin Gachichio and Chief of Staff Paul Wambugu to appear and shed light on grey areas in regard to Gakuru’s death.
When the case came up for hearing and site visit at Makenji in kabati area the four officers were nowhere to be seen prompting prosecutor Kennedy Magoma to apply for their arrest for disobeying court order.
While issuing the arrest warrant Kagendo said that it’s unfortunate that the four have made her crew to waste public money and they must face the consequences.
Nyeri governor Mutahi Kahiga was summoned to shed light on a statement that he made moments after Gakuru’s death saying that he had forewarned Gakuru not to use the vehicle due to its mechanical state.
Gakuru’s family laywer Mary Weru who applied for summoning the governor said that it’s prudent for Kahiga to shed light since he was a direct beneficiary of Gakuru death.
“Your honor it’s good if the governor appear in court , he made this remark in public at Kimathi university and as such let him she’d light on it ” said Weru.
Ms. Weru also successfully applied for summon of county secretary Bejamin Gachichio and county chief of staff Paul Wambugu to shed light on staff assigned to Gakuru before death.
In regard to Mathira MP Rigathi Gachagua the lawyer said that he must also appear in court to testify due to the fact that before his death he had instituted audit on use of funds some of which he was said to have misappropriated during his brother’s era.
While summoning him Kagendo said that Rigathi was a person of interest in the inquest and such he should also appear. Kagendo set hearing of the case on 23/24 September at Makenji.
